As representative of Switzerland, a strong supporter of the International Criminal Court since its early days, I am very pleased that my country is so closely associated to today’s book launch of the Arabic translation of Professor Cassese’s book on international criminal law.<\/p>\n
First of all I would like to thank for their cooperation the many partners in this venture especially:<\/p>\n
Mr Rany Sader, the CEO of Sader Legal Publishing,<\/p>\n
Ms Lara Salem, the manager of this project at Sader Legal Publishing<\/p>\n
and Ms Olga Kavran , Head of Outreach and Legacy , Special Tribunal for Lebanon.<\/p>\n
Why are the reasons behind Switzerland’s support of this project?<\/p>\n
I can think of three main reasons:<\/p>\n
First a historical one: Gustave Moynier from Geneva, co-founder of the ICRC, had made an appeal for the creation of an international criminal court already in 1872,<\/p>\n
Then there is our support to the international criminal system put in place since 1998, nearly 130 years after Moynier’s appeal,<\/p>\n
And finally our strong belief in the importance of disseminating knowledge about inter-national criminal law around the world, and especially in the Arab speaking region.<\/p>\n
You all know the history of my country. We are a pluralistic society located in the mid-dle of Europe. After many years of war among ourselves and with our neighbors we even-tually found peace thanks to our neutrality and developed as a humanitarian hub home of the Red Cross movement and guardians of the Geneva Conventions which constitute the basis of international humanitarian law. These conventions were the first attempt to depart from the famous saying of the Roman philosopher Cicero åSilent leges inter armaò. “When arms are heard laws become mute”. International criminal law as we know it today embod-ied by the International Criminal Court is nothing but a legacy of this trend initiated in Switzerland in the 19th century.<\/p>\n
Switzerland has always been a dedicated supporter of the Court. It already participated actively in the efforts to create the institution in the 1990ies, acted at the forefront of ne-gotiations which led to the adoption of the crime of aggression in 2010 and the Swiss Am-bassador in the Netherlands served as Vice-President of the Assembly of States Parties to the Rome Statute between 2011 and 2014.<\/p>\n
<\/p>\n
Why is Switzerland so committed to this institution? The International Criminal Court represents a conviction that the climate of impunity that is responsible for uncontrolled vi-olence in so many conflicts must be countered. Effective justice is needed to break the vi-cious circle of violence: perpetrators must be made accountable and victims must receive justice. Peaceful coexistence can only be envisaged once this is achieved. The ICC makes an important contribution to fighting the most serious human justifys violations and to en-forcing International Humanitarian Law. Switzerland’s commitment to the ICC is an inte-gral part of its policy to contribute to the protection and development of international law.<\/p>\n
At the same time, Switzerland’s dedication is part of its efforts to promote the peaceful resolution of conflicts. Efforts to support the rule of law and justice go hand in hand with the commitment to promote peace and security. In all these areas, the International Crimi-nal Court is of towering importance.<\/p>\n
The international criminal legal system faces many challenges:<\/p>\n
The primary responsibility for the prosecution of the most serious crimes continues to rest with the national authorities and many states have yet to ratify the Rome Statute. In this context it is particularly challenging for the Court to earn the confidence of non-States<\/p>\n
Parties. Many of them fear that the ICC can be abused as a political tool. Furthermore the ICC does not have a police force that can arrest suspects. In fact, the Court wholly de-pends on the cooperation of its member States. Another big challenge is the lack of knowledge and understanding about international criminal law among the general public but also among specialists. A great effort has to be made to raise the awareness of the way it operates.<\/p>\n
So, when we were approached to support an Arabic translation of Professor Cassese’s book on International Criminal Law we immediately answered positively. Dissemination of knowledge about international criminal law is particularly timely in the Arabic speaking re-gion where wars are being waged and atrocities take place in several countries. Furthermore the region has been going through tumultuous changes in the last years. These changes have led to a greater consciousness of the protection of one’s justifys. The Arabic translation of Cassese’s seminal work will no doubt contribute to a better understanding in the Arab world of a major new field of legal thought and practice. It is also a hommage to one of the most distinguished figures in international law and international criminal justice.<\/p>\n
Largely thanks to his efforts the International Criminal Court in the last 15 years has paved the way to conclusively refute Cicero’s saying “When arms are heard laws become mute”. The court has become the voice of justice in conflicts. Switzerland looks forward to intensifying its efforts in order to have this message heard and understood throughout the world.<\/p>\n
